Human trafficking and human smuggling effectively addressed in Caribbean Netherlands

Human trafficking is a horrific crime. It is often referred to as the modern form of slavery and is a violation of human rights. Human trafficking is the exploitation of men, women and children by putting them under duress or by deception to work. In the Caribbean region, we find victims, usually in the sex industry, hotel and catering, construction or domestic help.

Human smuggling is bringing migrants across the border illegally. Often this comes with the smuggling of drugs and firearms. Smuggling can be dealt with most efficiently through cooperation between the services. Therefore, the chain partners of the Working Group on Trafficking in human beings and smuggling in human beings; Police (detection and office for Victim Assistance), Immigration and Naturalization Service (IND), Public Prosecution, Royal Constabulary, Guardianship Council, the Public Entity and Social Affairs are joining force to give an extra impetus to the joint approach to human trafficking. In the Working Group an integral Plan of Action against trafficking in human beings has been prepared with a link to the Covenant Theme registry Trafficking in human beings and smuggling of human beings and the Roadmap Victims. Both documents were signed yesterday by the concerned partners.

The purpose of the Covenant Theme registry is to effectively address the prevention of and fight against trafficking in human beings and human smuggling. This means that signals can be better registered with the police. Multiple notifications can ultimately lead to an investigation against one or more defendants. The roadmap is intended to act as efficiently and effectively as possible through the chain partners when there is a possible victim.

Victims should be removed, as soon as possible, from the exploitative situation; perpetrators must be prosecuted as soon as possible. But of course, we must do everything to prevent the crimes. That is why all countries and islands in the Kingdom (including Caribbean Netherlands), upon the request of the Minister of Justice, have made an integral Plan of Action against trafficking in human beings. The Working Group on trafficking in human beings and human smuggling has already done plenty throughout the years. In the plan some new emphasis has been laid. The Plan of Action includes activities in the field of education. Therefore, there will be more information given, for example to employers and employees in the construction and in the hospitality industry.
It was agreed to carry out controls more often together with multiple services. The Public Entity Bonaire (OLB) will check for compliance of the permit conditions of companies, the IND will look at the residency papers and Social Affairs the working conditions.

From the criminal law angle, the focus will be on the taking away of criminal power. Profit is the main driving force of traders and smugglers

Mensenhandel en Mensensmokkel effectief aangepakt in Caribisch Nederland

Mensenhandel is een gruwelijk misdrijf. Het wordt vaak aangeduid als de moderne vorm van slavernij en is een schending van de mensenrechten. Mensenhandel is de uitbuiting/exploitatie van mannen, vrouwen en kinderen door ze onder dwang of door misleiding te laten werken. In de Caribische regio treffen we slachtoffers meestal aan in de prostitutie, de horeca, de bouw of in de huishoudelijke hulp.

Mensensmokkel is het illegaal over de grens heenbrengen van migranten. Vaak gaat dit gepaard met het smokkelen van drugs en vuurwapens. Smokkel kan het efficiëntst aangepakt worden door samenwerking tussen de diensten. Daarom slaan de ketenpartners van de werkgroep Mensenhandel en Mensensmokkel; Politie (opsporing en Bureau voor Slachtofferhulp), IND, Openbaar Ministerie, Koninklijke Marechaussee, Voogdijraad, het Openbaar Lichaam en Sociale Zaken en de handen ineen om een extra impuls te geven aan de gezamenlijke aanpak van menshandel. In de werkgroep is een Integraal Plan van Aanpak tegen mensenhandel opgesteld met hieraan gekoppeld het Convenant Themaregister Mensenhandel en Mensensmokkel en het Draaiboek Slachtoffers. Beide documenten zijn gisteren ondertekend door de betrokken partners.

Het doel van het Convenant Themaregister is om de preventie en de bestrijding van mensenhandel en mensensmokkel effectief aan te pakken. Dit betekent dat signalen beter kunnen worden geregistreerd bij de politie. Meerdere meldingen kunnen uiteindelijk leiden tot een opsporingsonderzoek tegen een of meerdere verdachten. Het draaiboek is bedoeld om zo efficiënt en effectief mogelijk op te treden door de ketenpartners als er sprake is van een mogelijk slachtoffer.

Slachtoffers moeten zo snel mogelijk uit de uitbuitingssituatie worden gehaald, daders moeten zo snel mogelijk worden vervolgd. Maar uiteraard moeten we alles doen om de misdrijven te voorkomen. Daarom hebben alle eilanden en landen in het Koninkrijk (inclusief Caribisch Nederland) op verzoek van de ministers van Justitie een Integraal Plan van Aanpak gemaakt tegen mensenhandel. De werkgroep mensenhandel en mensensmokkel heeft door de jaren heen al veel gedaan. In het plan worden enkele nieuwe accenten gelegd. Het plan van aanpak bevat onder andere activiteiten op het terrein van voorlichting. Zo zal er meer voorlichting gegeven worden, bijvoorbeeld aan werkgevers en werknemers in de bouw en in de horeca.
Afgesproken is om met meerdere diensten samen vaker te gaan controleren. Het OLB gaat controleren op de naleving van de vergunningsvoorwaarden van bedrijven, de IND kijkt naar de verblijfspapieren en Sociale Zaken naar de arbeidsomstandigheden.

Vanuit de strafrechtelijke hoek gaat de focus liggen op het afpakken van crimineel vermogen. Winst is uiteindelijk de belangrijkste drijfveer van de handelaren en de smokkelaars.
